Welcome to the ThriftHunt mobile app ("ThriftHunt"), provided by Limitless Being LLC ("We", "Us", "Company"). These Terms of Service, together with our Privacy Policy and any other documents they expressly incorporate, set forth the terms and conditions upon which you may access and use the ThriftHunt app and the services provided by Limitless Being LLC ("Service"), including any content and functionality offered through the Service ("Terms of Service" or "Agreement").

PLEASE READ THE TERMS OF SERVICE CAREFULLY BEFORE YOU START TO USE THE SERVICE. BY USING THE SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST 13 YEARS OF AGE. FURTHER, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS OF SERVICE. IF YOU ARE NOT 13 YEARS OLD OR DO NOT WANT TO AGREE TO THESE TERMS OF SERVICE, YOU MUST NOT ACCESS OR USE THE SERVICE.

We reserve the right to change, add or remove portions of these Terms of Service and any documents incorporated herein at any time and at our sole discretion. Your continued use of the Service following the posting of revised Terms of Service means that you accept and agree to the changes.

1. Use of the Service

General

Subject to the terms and conditions of this Agreement, and during the term of this Agreement, Limitless Being LLC grants you a non-exclusive and non-transferable right to access and use the Service in accordance with the terms of this Agreement, and any documentation made available to you by Limitless Being LLC, solely for your personal, non-commercial use.

The Service is enabled by technology, software, and certain content delivered electronically. You agree that you will not reverse-engineer, decompile, disassemble, translate, or otherwise attempt to obtain access to the source code of, any aspect of the Services, including any and all technology, software and content. You will not copy, reproduce, alter, create derivative works from, or otherwise modify the Services. You will not lease, loan, sublicense, distribute, or otherwise provide others access to any aspect of the Services.

Description of Service

The ThriftHunt Service is an AI-powered mobile app designed to help thrift shoppers identify and assess the resale value of secondhand items using artificial intelligence and image recognition technology. The Service allows users to scan items via camera, receive AI-generated analysis including item identification, estimated market value, and marketplace data. Key features include:

• AI-powered image scanning and item identification
• Resale value estimation and market analysis
• Historical marketplace data from third-party sources
• Interactive map showing user-shared discoveries ("Flip Map")
• Social sharing functionality with shareable links
• Location-based features for discovering nearby finds
• Item claiming functionality for map discoveries
• User-generated content sharing and community features

The Service integrates with third-party APIs and services to provide marketplace data, location services, and AI analysis. All estimates, valuations, and marketplace data are provided for informational purposes only and should not be considered professional appraisals or investment advice.

2. Registration and Account Security

You may be required to register for the Service and provide certain information about yourself. All information we collect about you in connection with the Services is subject to our Privacy Policy. By using the Service, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

You will receive a user account for your personal use, which may be created through services like Apple Sign In or Google Sign In. You are responsible for all activities that occur under your user account. You shall:

• Have sole responsibility for the accuracy, quality, integrity, legality, and reliability of all data you provide
• Maintain the confidentiality of your account information
• Use commercially reasonable efforts to prevent unauthorized access to, or use of, the Service, and notify the Company promptly of any such unauthorized use

• Not create multiple accounts or share your account with others
• Not use the Service for any commercial resale or business purposes without our express written consent

3. User Responsibilities and Legal Compliance

Photography and Intellectual Property

You are solely responsible for ensuring that you have the legal right to photograph and share images of items through the Service. This includes:

• Obtaining permission from store owners or property managers before photographing items on private property
• Respecting store policies regarding photography and mobile device usage
• Ensuring you do not violate any intellectual property rights of item manufacturers, designers, or retailers
• Understanding that photographing items does not grant you any ownership rights to those items or their intellectual property

The Company is not responsible for any legal consequences arising from your photography activities, including but not limited to trespassing, violation of store policies, or intellectual property infringement.

Physical Safety and Location-Based Activities

You acknowledge and agree that:

• All travel to locations and physical activities related to claiming or viewing items are undertaken at your own risk
• The Company is not responsible for your safety or security when traveling to locations or meeting other users
• You are responsible for verifying the safety and legitimacy of locations before visiting
• GPS and location data may be inaccurate, and you should use your own judgment regarding location information
• You should take appropriate safety precautions when visiting unfamiliar locations or meeting other users

Store Relations and Business Interference

You agree that:

• You will not use information from the Service to harass, pressure, or interfere with store operations
• You will not engage in bulk purchasing activities that could disrupt store inventory or operations
• You understand that stores may change their policies regarding mobile device usage or photography as a result of app usage
• The Company is not responsible for any store bans, policy changes, or business relationship disruptions that may result from your use of the Service

4. User-Generated Content and Sharing

Content You Share

When you use the Service, you may share photos, location data, item information, and other content ("User Content"). By sharing User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to share all User Content
• Your User Content does not infringe on the rights of any third party
• Your User Content does not contain illegal, harmful, or offensive material
• You have the right to photograph and share images of items you scan
• Your User Content does not violate any store policies or private property rights

Location and Map Features

The Service includes location-based features that allow you to:

• Share your finds on a public map for other users to discover
• Claim items shared by other users within a reasonable proximity
• View discoveries from other users in your area

By using location features, you acknowledge that:

• Your location data will be shared with other users when you make items public
• Shared items automatically expire after 14 days to maintain content freshness
• You must be within a close range to claim it
• Claiming items requires you to be physically present at the location
• Location data may be inaccurate and should not be solely relied upon
• You are responsible for verifying the accuracy of location information

5. Content Moderation and Reporting

The Company reserves the right, but has no obligation, to monitor, review, or moderate User Content. We may remove or restrict access to any User Content that violates these Terms of Service or that we determine, in our sole discretion, is inappropriate or harmful.

Users may report inappropriate content or behavior through the Service. However, the Company makes no guarantee regarding response times or actions taken in response to reports.

You acknowledge that the Company cannot and does not guarantee the accuracy, reliability, or appropriateness of User Content shared by other users.

6. Disclaimer for AI-Generated Content and Market Valuations

The item identifications, market valuations, pricing estimates, and all other analysis provided through the ThriftHunt Service are generated by artificial intelligence and third-party data sources and are intended for general informational purposes only.

By using the Service, you acknowledge and agree that:

Accuracy is Not Guaranteed: AI-generated content and market valuations may contain errors, inaccuracies, or omissions. We make no guarantees regarding the accuracy, reliability, or completeness of any information provided, including item identifications, price estimates, or market data.

Not Professional Appraisals: The Service does not provide professional appraisals, investment advice, or certified valuations. All estimates are algorithmic approximations based on available data and should not be relied upon for insurance, tax, or legal purposes.

Market Conditions Vary: Actual resale values depend on numerous factors including item condition, local market demand, timing, selling platform, and individual selling skills. Past sales data does not guarantee future results.

Third-Party Data Limitations: Market data is sourced from third-party platforms and may not reflect current market conditions, regional variations, or complete sales histories.

The Company is not responsible for data loss resulting from account deletion or Service termination.

Your use of the Service must comply with the applicable terms of the platform through which you access the Service, including but not limited to the Apple App Store Terms of Service and Google Play Terms of Service.

The Service may offer both free and paid subscription tiers. Free users may have limited access to certain features or a restricted number of scans per month. Paid subscribers receive unlimited access to all features and full market data.

Payment terms, if applicable, will be clearly disclosed at the time of subscription. All subscription fees are non-refundable unless otherwise required by law.

13. Term and Termination

The term of this Agreement will begin upon your successful registration for the Service and will continue indefinitely unless terminated by either party as permitted herein.

The Company may suspend or terminate your access to the Service at its sole discretion, without notice, if you:

• Engage in any conduct that the Company determines may have an adverse effect on the Company, the Service, or its reputation
• Violate our Community Guidelines
• Use the Service in a way that could harm other users or the Service

• Location data when you use location features

All data collection and use is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service.

15. Intellectual Property Ownership

Except for the limited license and use rights expressly granted to you under these Terms of Service, all title to and the rights in the Service, including any and all technology, software, and content (including AI-generated analysis and market data), and including ownership rights to patents, copyrights, trademarks, and trade secrets, is the exclusive property of the Company and/or its third-party licensors.

The ThriftHunt name, logo, and all related trademarks are the property of Limitless Being LLC.

16. Non-Confidential Information

Subject to any applicable terms and conditions set forth in our Privacy Policy, any communication or material that you send to us or transmit through the Service, such as photos of items, questions, comments, or suggestions, is and will be deemed to be non-confidential. We will have no obligation of any kind with respect to such information and will be free to use any ideas, concepts, know-how, or techniques contained in such communication for any purpose whatsoever, including but not limited to, developing and marketing products and improving the Service.

17. Service Access and Changes

We reserve the right to withdraw or amend this Service, and any material we provide in connection with the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. We may also update the content on this Service, including AI algorithms, market data sources, and other features, from time to time. However, we cannot guarantee that the content is always complete or up-to-date.

18. Age Restrictions

The Service is not intended for use by individuals under the age of 13. We do not knowingly collect personal information from or provide Services to anyone under the age of 13. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or guardian.

19. Indemnity

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, partners, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, or demands, liabilities, and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Service, your violation of these Terms of Service, your User Content, your photography activities, your interactions with other users, your travel to locations, or any disputes arising from your use of location-based features.

20. DISCLAIMER OF WARRANTIES

THE THRIFTHUNT SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NEITHER THE COMPANY NOR ITS AFFILIATES WARRANT THAT USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. THE COMPANY AND ITS AFFILIATES SPECIFICALLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE COMPANY OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

THE COMPANY MAKES NO WARRANTIES REGARDING THE ACCURACY OF LOCATION DATA, THE SAFETY OF LOCATIONS, THE LEGITIMACY OF OTHER USERS, OR THE ACCURACY OF AI-GENERATED CONTENT.

21. Limitation of Liability

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. THIS INCLUDES, BUT IS NOT LIMITED TO, RELIANCE BY YOU ON ANY INFORMATION OBTAINED FROM THE SERVICE, FINANCIAL LOSSES FROM PURCHASING OR SELLING DECISIONS, LOCATION-BASED INCIDENTS, PHYSICAL HARM OR INJURY, THEFT OR FRAUD, DISPUTES WITH OTHER USERS, STORE BANS OR POLICY CHANGES, INTELLECTUAL PROPERTY DISPUTES, TRESPASSING CLAIMS, OR THAT RESULTS FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO THE COMPANY'S RECORDS, PROGRAMS, OR SERVICES.

IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS OF SERVICE, THE COMPANY IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, THE COMPANY'S LIABILITY WILL IN NO EVENT EXCEED THE AMOUNT OF FEES PAID BY YOU, IF ANY, DURING THE PRECEDING 12-MONTH PERIOD FOR THE SERVICE.

22. Governing Law

You agree that all matters relating to your access to or use of the Service, including all disputes, will be governed by the laws of the United States and the laws of the State of Delaware without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Delaware, and waive any objection to such jurisdiction or venue.

23. Waiver of Trial by Jury

EXCEPT WHERE PROHIBITED BY LAW, YOU EXPRESSLY WAIVE TRIAL BY JURY IN ANY JUDICIAL PROCEEDING INVOLVING ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS OR THE SERVICE.

24. General Provisions

No Waiver: The failure of the Company to insist on or enforce strict performance of these Terms of Service will not be construed as a waiver by the Company of any provision or any right it has to enforce these Terms of Service.

Severability: The provisions of these Terms of Service are severable. The invalidity, in whole or in part, of any provision of these Terms of Service will not affect the validity or enforceability of any other of its provisions.

Entire Agreement: These Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and Limitless Being LLC regarding the Service and supersede all prior understandings, agreements, representations, and warranties, both written and oral.
